Terms and Conditions

This English text is a translation provided for convenience. In case of any discrepancy, the Hungarian version of the Terms and Conditions is legally binding. Questions: we.are@loblolly.eu.

These General Terms and Conditions (hereinafter: GTC) set out the terms of use of the webshop operated by Nautilus System Kft. (hereinafter: Service Provider) under the domain name loblolly.eu, and the terms governing purchases made through it. The content of the contract concluded between the Service Provider and the person ordering a product through the website (hereinafter: User) is determined by these GTC together with the applicable statutory provisions. Accordingly, these GTC set out the rights and obligations of the contracting parties, the conditions for the conclusion of the contract, the delivery and payment terms, as well as the conditions for exercising the right of withdrawal. Before finalising an order, the User is required to familiarise themselves with the provisions of these GTC. By purchasing through the webshop, the User accepts the provisions of these GTC. Products loblolly.eu is a webshop primarily dealing in wall-mounted cartographic decorative products, where the User has the option to order the products displayed on the pages of the webshop. Unless indicated otherwise, the price shown next to the products is the unit price; the prices include 27% Value Added Tax (VAT) but do not include the shipping fee. The shipping cost is displayed separately during the order process, is subsequently shown on the invoice as well, and is automatically added to the total amount. Any User may use the webshop free of charge. Purchases can be made both with and without registration. The webshop may only be used by Users who have reached the age of 18. By accepting the GTC, you declare that you have reached the age of 18.

Steps of the order 1. Adding the product to the cart Products can be selected under the various categories and added to the cart by clicking the "Add to cart" button. The purchase can then be continued, or the order can be finalised. 1. Contents of the cart By clicking the "Cart" button in the menu bar, the User can enter the cart menu, where the order can be modified, products can be removed, and a coupon code can be entered. 1. Providing the details During the order, the User must provide their name, e-mail address, telephone number, as well as the delivery address and billing details. The User can then select the delivery and payment method. 1. Submitting the order The User can only submit the order if they accept the General Terms and Conditions. By submitting the order, the User incurs a payment obligation. 1. Confirmation After the order has been placed, the system sends a confirmation e-mail to the e-mail address provided by the User, containing all data and information relating to the order.

Confirmation of the order The Service Provider sends an e-mail notification to the User regarding orders sent and received. The confirmation contains the delivery and billing address, the name, the amount of the order, and the delivery and payment method. If the confirmation e-mail does not arrive in the e-mail account provided by the User, the User is released from the offer or contractual obligation and will therefore not be obliged to purchase the ordered items. Please note that the e-mail may end up in the spam folder.

Processing of the order Orders may be placed 24 hours a day. Orders received are processed by the Service Provider on business days between 9:00 a.m. and 4:00 p.m. Beyond the processing time, the

orders placed on weekends and public holidays are processed on the next business day.

Delivery The Service Provider delivers the ordered product to the User either by personal collection or by shipping. The Service Provider bears no responsibility for delivery delays or other problems attributable to incorrectly or inaccurately provided delivery details. The delivery deadline depends on the time the order is placed and on stock availability. You may encounter the following stock information in the cart section of the website: •

in stock: in this case the selected product is in stock and will be packaged immediately, or in the case of personal collection it can be collected after the order is finalised, following an appointment; arriving soon: in this case the selected product is not in stock, but production is in progress; our customers are notified by e-mail of the expected arrival; on order only: in this case the selected product is not in stock and its arrival is expected at a later date; our customers are likewise notified of this by e-mail.

Location of personal collection: Nautilus System Kft., 1115 Budapest, Bartók Béla út 105-113. There is no delivery fee for personal collection. The exact time of collection is agreed in advance by the Service Provider with the User. The Service Provider provides information on the possible collection period in the confirmation e-mail. If the ordered product is in stock, it will be shipped within 7 days from the date of conclusion of the contract. In the event of high demand, a shortage may occur for certain products, in which case the delivery deadline may be longer. The User will be informed of this. In the case of shipping, the integrity of the package must be checked in the presence of the courier upon receipt of the shipment! Do not accept a damaged package! The shipping fee is HUF 2,540 gross. Shipping is free of charge for orders over HUF 127,000 gross. In the case of undelivered/returned packages, the Service Provider charges the return shipping cost to the User, and the Service Provider is only able to resend the package upon prior transfer of its value! Payment terms and invoicing

Cash In the case of personal collection or cash on delivery, the User pays the purchase price of the order (and the shipping fee) in cash upon receipt.

Online card payment Online card payments are carried out through the Barion system. Card details are not transmitted to the merchant. The service provider, Barion Payment Zrt., is an institution supervised by the Magyar Nemzeti Bank (National Bank of Hungary), licence number: H-EN-I-1064/2013.

Bank transfer The User may also pay the purchase price of the ordered products to the Service Provider by bank transfer. The purchase price is deemed paid once it has been credited to the Service Provider's bank account, after which the package is dispatched to the User. In the case of a transfer, the order number must be indicated in the payment reference. Name of bank: UniCredit Bank Zrt. Invoicing The Service Provider sends the invoice to the User enclosed with the package, using the InnVoice invoicing system.

Right of withdrawal A User qualifying as a consumer may withdraw from the contract without giving any reason within 14 days of receipt of the ordered product. If the User wishes to exercise the right of

withdrawal, they must notify the Service Provider of this in due time in writing (withdrawal statement) or by telephone. The User must return the ordered product to the Service Provider's address by postal mail or courier service. The shipping costs relating to the return are borne by the User. The Service Provider is not able to accept packages returned cash on delivery. The Service Provider is entitled to claim compensation from the User for any material damage resulting from use other than as intended. A video recording is made of the opening and inspection of the returned package in order to establish and record whether the product is damaged or incomplete. The Service Provider is obliged to refund the purchase price to the User within 14 days at the latest of receipt of the returned package. When making the refund, the Service Provider uses the same payment method as that used in the original transaction, unless the User expressly consents to a different payment method. The Service Provider may withhold the refund until it has received the product back, or until the User has provided proof that it has been sent back, whichever occurs first. Under Section 8:1 (1) point 3 of the Hungarian Civil Code (Ptk.), only a natural person acting outside the scope of their profession, independent occupation or business activity qualifies as a consumer. The User also has the option of cancelling the order by e-mail or telephone while the order is being processed.

Information on warranty for defects (kellékszavatosság) and product warranty (termékszavatosság)

Warranty for defects (kellékszavatosság) In which cases may you exercise your right to a warranty for defects? In the event of defective performance by Nautilus System Kft., you may assert a warranty claim against the company in accordance with the rules of the Hungarian Civil Code. What rights are you entitled to on the basis of your warranty claim? At your discretion, you may assert the following warranty claims: You may request repair or replacement, unless fulfilling the claim of your choice is impossible or would involve disproportionate additional costs for the company compared to fulfilling another claim. If you did not or could not request repair or replacement, you may

request a proportionate reduction of the consideration, or you may repair the defect yourself or have it repaired by someone else at the company's expense, or, as a last resort, you may withdraw from the contract. You may switch from one warranty right you have chosen to another, but you shall bear the cost of doing so, unless it was justified or the company gave cause for it. Within what time limit may you assert your warranty claim? You are required to report the defect immediately after its discovery, but no later than within two months of discovering it. Please note, however, that you may no longer assert your warranty rights beyond the two-year limitation period calculated from the performance of the contract. Against whom may you assert your warranty claim? You may assert your warranty claim against the company. What other conditions apply to the assertion of your warranty rights? Within six months of performance, there is no condition for asserting your warranty claim other than reporting the defect, provided you prove that the product or service was provided by Nautilus System Kft. However, after six months have elapsed since performance, you are required to prove that the defect you have identified already existed at the time of performance.

Product warranty (termékszavatosság) In which cases may you exercise your right to a product warranty? In the event of a defect in the product, you may, at your discretion, assert either a warranty for defects claim or a product warranty claim. What rights are you entitled to on the basis of your product warranty claim? As a product warranty claim, you may only request the repair or replacement of the defective product. In which cases is a product considered defective? A product is defective if it does not meet the quality requirements in force at the time it was placed on the market, or if it does not have the characteristics described by the manufacturer. Within what time limit may you assert your product warranty claim? You may assert your product warranty claim within two years of the product being placed on the market by the manufacturer. You lose this right upon expiry of this time limit.

Against whom, and under what other conditions, may you assert your product warranty claim? You may only exercise your product warranty claim against the manufacturer or distributor of the product. In the case of asserting a product warranty claim, you must prove the defect in the product. Under what circumstances is the manufacturer (distributor) exempt from its product warranty obligation? The manufacturer (distributor) is exempt from its product warranty obligation only if it can prove that: • • •

it did not manufacture or place the product on the market in the course of its business activity, or the defect was not detectable according to the state of science and technology at the time it was placed on the market, or the defect in the product resulted from the application of legislation or a mandatory official regulation.

It is sufficient for the manufacturer (distributor) to prove a single ground for exemption. You may not assert a warranty for defects claim and a product warranty claim simultaneously and in parallel for the same defect. However, if your product warranty claim is successfully asserted, you may assert your warranty for defects claim relating to the replaced product or the repaired part against the manufacturer.

Legal statement The Service Provider excludes all liability for the conduct of the users of the website. In the event that any infringement arises, the Service Provider cooperates with the acting authorities for the purpose of investigation. The Service Provider is not liable for any damages arising from a possible malfunction of the server or from the alteration of the content of the website by a third party. When ordering products, the User is required to provide their own, accurate data. In the event that untrue data, or data linked to another person, is provided during the purchase/order, the resulting electronic contract shall be null and void. The Service Provider excludes its liability in the event that the User uses its services in another person's name, using another person's data. The Service Provider bears no liability whatsoever for any delay or other problem or error attributable to data incorrectly and/or inaccurately provided by the User. If, despite all due care on the part of the Service Provider, an incorrect price appears on the website, in particular an obviously erroneous price that differs significantly from the well-known, generally accepted or estimated price of the product, or a price of HUF 0 or HUF 1 appearing due to a system error, the Service Provider is not obliged to sell the product at the incorrect price, but may offer to perform the service at the correct price, upon becoming aware of which the Customer may withdraw from their intention to purchase.

Everyone uses the website at their own risk. The Service Provider cannot be held liable for any delay or error occurring in the system, or for any resulting incomplete flow of information. The Service Provider is the holder of the copyright to all content displayed during the provision of the services available through the website: any copyrighted work or other intellectual creation (including all commissioned graphics, images, photographs, and the layout of the website's interface, ideas and implementations). No provision of these GTC grants the User any right to use or exploit any trade name or trademark appearing on the website. Beyond the display associated with the intended use of the website, the temporary reproduction necessary for this purpose, and the making of copies for private use, these intellectual creations may not be used in any other form without the prior written consent of the Service Provider.

Complaint handling and enforcement of rights The User may submit complaints regarding the purchased product to the Service Provider at the following contact details, by e-mail (info@nautilussystem.hu) or by telephone (+36 21 202 8574). The Service Provider responds to user complaints within 30 days at the latest. If a consumer dispute that may arise between the Service Provider and the consumer is not resolved, the following means of enforcing rights are available to the consumer: •

Consumer protection authority: If a consumer detects a violation of their consumer rights, they are entitled to lodge a complaint with the consumer protection authority competent for their place of residence. Following assessment of the complaint, the authority decides on whether to conduct consumer protection proceedings. The first-instance consumer protection authority tasks are performed by the metropolitan and county government offices competent for the consumer's place of residence; a list of these can be found at: kormanyhivatal.hu Court proceedings: The User is entitled to enforce their claim arising from a consumer dispute before a court within the framework of civil proceedings. Conciliation Body: If a consumer complaint is rejected, the consumer is also entitled to turn to the Conciliation Body competent for their place of residence or stay: a precondition for initiating proceedings before the conciliation body is that the consumer must have attempted to resolve the dispute directly with the business concerned. The conciliation body has jurisdiction to settle consumer disputes out of court. The task of the conciliation body is to attempt to bring about a settlement between the parties in order to resolve the consumer dispute; failing this, it renders a decision in the matter in order to ensure the simple, fast, efficient and cost-effective enforcement of consumer rights. Other provisions The legal relationship between the Service Provider and the User is governed by Hungarian law. These GTC are concluded in electronic form and exclusively in the Hungarian language. The contract thus concluded shall qualify as a contract in writing. The Service Provider is entitled to use a contributor to fulfil its obligations, for whose unlawful conduct it bears full liability, as if it had committed the unlawful conduct itself. The Service Provider may amend these GTC at any time without giving any reason, and will notify the User of this via the website. Please review the General Terms and Conditions regularly. In matters not regulated by these GTC, the provisions of the applicable legislation shall apply. By browsing the pages of the website and by placing orders, the User accepts the content of the GTC.
